In a move that could greatly up the ante in the clash between the Zardari government and the Pakistani judiciary, A top lawyer of the Pakistani Supreme Court warned that they could call in the army to enforce their rulings in the administration declined to do so.
Last month the Supreme Court declared the National Reconciliation Ordinance (NRO) unconstitutional, stripping several key members of the ruling party of legal immunity from a littany of corruption charges stemming from their roles in the previous administrations.
Though President Zardari hypothetically retains immunity through his office, it has also been argued that Zardari’s election was itself illegal because he would have been unable to run without the NRO in place.
Zardari’s ruling Pakistani Peoples Party (PPP) has unsuccessfully petitioned to have Zardari’s immunity retroactively restored, and the court said they could issue another appeal to the decision.
At the same time, Zardari is said to be under growing pressure to resign, with media outlets reporting that he has been sent “umpteen” messages from government institutions, including the military, which have been working with Prime Minister Yousef Raza Gilani, one of the few top PPP members not currently under charges.

Already there are questions being asked as to why the Supreme Court is no longer pro-active on other cases except relating to President Zardari. Clearly, the judges' zeal for populism is creating a situation where the politicians might be left with no choice except to castrate the judiciary and deprive it of many of the powers that the judges are arrogating to themselves. What is more, the military establishment too could end up siding with the political class against the judges. After all, if the courts reopen the infamous ISI pay-offs case – the Mehran bank scandal – then a lot of former senior officials will have their necks on the block. If it was only old cases like the Mehran bank scam, perhaps the current military leadership would not lose too much sleep.
The PPP is an asset of this nation. It cannot allow its mandate to be thwarted because of certain Conspirators. No one today is bigger than the party. PPP is the real heir of democracy and Pakistan. Democracy in Pakistan was undermined sometimes by army dictators, sometimes by non-state actors and now by the incumbent Judiciary. Govt despite reservations welcomed the decision of judiciary on NRO and vowed to implement it in letter and spirit but what meant of overstepping constitutional domains?. Since President Zardari has immunity under Article 248, and, in international practice, has something called sovereign immunity, a reference cannot be made to the Swiss courts. Posting and transfer of officials and other such matters are strictly in the executive domain. It is very unfortunate and simply an attempt to pave path for another Judicial coup.
Time and again we tested dictatorship and the outcome was that dictatorship is a system quite disastrous and that democracy is the right choice for running the affairs of this state. Autocratic regimes not only totally failed to deliver but every time, it tore Pakistan to into pieces. Switching to the choice to army Generals is indeed not the will of people of Pakistan but very much wish of establishment and anti-state actors.
In democracy People elect a government and if it’s unable to satisfy the wants of the masses, they switch their choices and votes in the next polling. The government changes and people are able to test multiple candidates upon the honor of their words. But dictatorship does not give you such choice. Here you have to follow whatever a dictator promulgates. Now if Judiciary paves the way for autocracy axing the incumbent Govt, it would be unfair and unjust with this nation and soil.
